Balancing and the structure of constitutional rights
In the above article in the July 2007 issue (Vol. 5, p. 453), due to a copy editing error, the following sentence appeared in the conclusion on page 468:
A more nuanced conclusion—namely, that all constitutional rights, as a matter of structure, are necessarily balancing norms—would still have been substantially innovative and challenging.
This should rather have stated:
A more nuanced conclusion than Alexy's claim that all constitutional rights, as a matter of structure, are necessarily balancing norms, would still have been substantially innovative and challenging [emphasis added by editor].
The editors of ICON apologize for the oversight.
